Understanding Ontario Time Limitations for Personal Injury Accidents

One of the areas of personal injury law that most people are unfamiliar with is the time limitations regarding when a claim can be filed. The first thing that you have to remember is that time limitations on personal injury cases are consistent throughout the province of Ontario. The limitation periods for filing a claim in Toronto are the same as in Hamilton or any other Ontario city or town. If you have been in accident and want to pursue a personal injury case in Ontario, then it helps to understand the guidelines you have to work with.

All personal injury claims are subject to limitations including:

  • brain injuries
  • spinal cord damage
  • slip and fall accidents
  • car accidents
  • animal bites
  • boating accidents

This list is not exhaustive as there are many other kinds of personal injury claims. It is always best to talk to a lawyer to make sure that your claim qualifies as a personal injury claim.

Adults Age 18 and Older

Regardless of the type of injury you have sustained and what kind of claim you are filing, there is a two-year limitation period on most personal injury claims in the province of Ontario. That means that you must file a claim within two years of the recorded date of the accident or you may lose your right to sue. This is why it is always good to have a police report created or make a claim with your insurance company as soon as an accident happens. That way you have an officially recorded date that you can use to help prove that your accident claim is valid.

Minors Under the Age of 18

The limitation period is slightly different for personal injuries that involve minors under the age of 18. If you are the victim of a personal injury accident and you are under the age of 18, then your limitation period does not officially begin until you turn 18, although you can commence a claim before that through a parent or adult guardian.
