Personal Injury While Involved in Minor Motor Vehicle Collision

Public TransitThere have been recent legislative changes that will impact people who have suffered a personal injury as a result of being in a car accident. Legislation implemented as of September 1, 2010 by the Ontario government has reduced the amount of medical and rehabilitative benefits sufferers are entitled to when involved in a minor vehicle collision.

The new Minor Injury Guideline (MIG), which replaced the Pre-Approved Frameworks, allows for faster dispensing of pre-approved medical treatment. However, it also dramatically decreases the financial coverage from $100,000 to just $3,500.

If you’ve been involved in a motor vehicle accident, it is important to first seek all necessary medical attention. Visiting a clinic or a hospital promptly will help ensure any health issues are addressed as soon as possible. No injury is too small to be checked by a doctor, as unforeseen problems can arise quickly in the future.

In order to receive compensation above $3,500, injured parties have to navigate the tricky landscape of dealing with insurance companies and their lawyers. To qualify for more benefits, those that are injured have to prove they already had a pre-existing medical condition which was exacerbated by the collision. Their pre-existing condition would entitle them to further medical and rehabilitative treatment. However, this is also limited to $50,000 worth of treatment. According to new legislation, minor injuries now encompass sprains and strains, subluxations, or partial dislocations of joints, abrasions, contusions, and lacerations.

The difficulty that often arises with these types of injuries is long-term impacts, especially in terms of psychological effects, chronic pain, or any other impact that falls outside the guideline.

While statistics have shown there has been a decline in the number of minor vehicle collisions in Ontario, there will always remain the possibility of a collision.
